Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Bvolvr ("we," "our," or "us") governing your access to and use of the Bvolvr Elite Performer Blueprint assessment platform, website, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Account Registration and Security

Account Creation

To access certain features, you must create an account by providing:

• Accurate and complete registration information
• A valid email address
• A secure password

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

Acceptable Use

Permitted Uses

You may use the Services to:

• Complete cognitive assessments for personal professional development
• Generate and download assessment reports
• Access development recommendations and insights
• Share badges and results as permitted by the platform
• Use features included in your subscription tier

Prohibited Uses

You may NOT:

• Violate Laws: Use Services for any illegal purpose or in violation of any applicable laws
• Infringe Rights: Violate intellectual property rights, privacy rights, or other rights of any party
• Impersonate Others: Misrepresent your identity or affiliation
• Share Accounts: Allow others to use your account or share your credentials
• Reverse Engineer: Attempt to reverse engineer, decompile, or extract source code from our Services
• Scrape Data: Use automated tools to scrape, copy, or monitor our Services without permission
• Circumvent Security: Attempt to bypass security measures or access restricted areas
• Interfere with Services: Disrupt, overload, or impair the functionality of our Services
• Manipulate Assessments: Provide false information or attempt to game assessment results
• Resell Services: Resell, redistribute, or commercialize our Services without authorization

Violation of these prohibitions may result in immediate termination of your account and legal action.

Intellectual Property Rights

Our Property

The Services, including all content, features, functionality, software, algorithms, assessments, reports, graphics, logos, and trademarks, are owned by Bvolvr and protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Our proprietary assets include but are not limited to:

• Cognitive assessment methodologies and algorithms
• Scoring systems and normative databases
• Report generation frameworks and templates
• AI prompt engineering and report structuring
• User interface designs and user experience flows
• Brand elements and visual identity

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or organizational professional development purposes, subject to these Terms.

Subscriptions and Payments

Subscription Plans

We offer various subscription tiers with different features and credit allocations:

• Free Tier: Limited features and assessment credits
• Individual Plans: Enhanced features and credit packages
• Coach/Advisor Plans: Professional features and bulk credits
• Team/Enterprise Plans: Organizational features and volume licensing

Billing

• Subscription fees are billed in advance on a monthly or annual basis
• Payment is processed through Stripe, our secure payment processor
• Prices are in USD (or local currency) and exclude applicable taxes
• You authorize us to charge your payment method for all fees incurred

Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can:

• Disable auto-renewal in your account settings at any time
• Continue to access Services through the end of your paid period after cancellation
• Re-enable subscriptions at any time

Assessment Accuracy and Limitations

No Guarantees

While we strive for accuracy, we make no guarantees regarding:

• Absolute accuracy of cognitive assessment results
• Specific career outcomes or performance improvements
• Suitability of recommendations for your specific situation

Professional Limitations

Our Services are designed for professional development purposes and should NOT be used for:

• Clinical diagnosis of cognitive disorders or mental health conditions
• Employment screening or hiring decisions (without proper validation and legal compliance)
• Medical or therapeutic purposes
• Legal proceedings or forensic evaluations
• High-stakes decisions without additional verification

Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy commitments:

• We do not sell your personal information
• Assessment data is confidential and encrypted
• You control sharing of your results
• You can request data deletion at any time

Disclaimers and Limitations of Liability

Service "As Is"

The services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Limitation of Liability

To the maximum extent permitted by law, Bvolvr shall not be liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost data, or business interruption.

Our total liability for all claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Termination

By You

You may terminate your account at any time through account settings. Termination is effective at the end of your current billing period.

By Us

We may suspend or terminate your access immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• Required by law or legal process
• We cease offering Services
